Overview

Allen Gardner is an attorney in the firm's First Amendment and Religious Organizations section. He spent 27 years at Latham & Watkins where he was a partner in the Washington, DC, office.

Mr. Gardner has represented diverse clients in a variety of litigation matters at both the trial and appellate levels. He has practiced extensively in torts, healthcare, and commercial and corporate disputes. He has served successfully as lead trial counsel for clients in numerous state and federal courts throughout the country where he has handled all aspects of trial work. He has defeated plaintiffs at trial who were seeking billions of dollars in damages. He has also successfully defended his trial court wins on appeal.

  • Trial counsel in successful arbitration defeating claims of breach of contract and unjust enrichment (2017)
  • Trial counsel in successful multibillion-dollar arbitration for communication company in breach of contract, unjust enrichment case (2016)
  • Lazard Technology Partners, LLC v. QinetiQ North America Operations LLC, Case No. 464, 2014 (Del. Apr. 23, 2015) (tried and defended on appeal complete defense verdict in breach of contract, implied covenant of good faith case)
  • Won injunctive motion for interim relief in arbitration in breach of contract action that effectively distinguished plaintiff’s claims (2014)
  • Foundation for Seacoast Health v. Hospital Corp. of America, 2012-371 (NH July 16, 2013) (trial counsel for two successful trials and appeals in billion-dollar breach of contract, covenant of good faith and fair dealing and unjust enrichment case)
