Overview
Brent Bastian is a member of the firm's Litigation section. He is an effective and efficient litigator who has gained an impressive record of success in several difficult areas of expertise, including business torts, contract claims, premises liability, sexual-abuse litigation, and agricultural law.
Brent’s results speak for themselves. For example, he represented a group of plaintiffs in a partnership action against a large hospital that resulted in a $60-million award for his client. The extraordinary judgment—which was among the 100 largest jury verdicts nationally in the year it was issued—came after years of hard-fought litigation, including an enormous and complicated eight-week trial, followed by a protracted appeal. In another matter, Brent convinced a bankruptcy court after a full trial to slash its award against a client by approximately $350 million, leaving the plaintiff to just a small fraction of the damages it had sought. Brent has also counseled The Church of Jesus Christ of Latter-day Saints in several of its Idaho cases and beyond.
Prior to Kirton McConkie, Brent spent several years working in-house for one of the largest companies in Idaho where he gained significant experience in several different disciplines while continuing to litigate. He is aware of the pressures businesses face in a variety of legal environments and is especially skilled at helping busy companies obtain digestible and usable advice, both before and after litigation arises.
